Terms and Conditions for The Change Agent
These Terms and Conditions (“Terms”) govern your access to and use of The Change Agent website, digital publications, and related services (collectively, the “Service”). This Service is owned and operated by the New England Literacy Resource Center (NELRC) at World Education (JSI Research & Training Institute Inc.). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.
1. Description of Service
The Change Agent is an online magazine for adult educators and learners. We provide free and low-cost teaching resources that feature writings by adult learners, along with classroom activities, opinion pieces, and other educational content. Our Service includes access to current and past issues of the magazine, as well as supplementary materials such as audio versions of articles, videos, and teaching guides.
2. Subscription and Access
- Subscription: Access to certain content on the Service requires an individual or bulk subscription. Subscription fees are subject to change and are non-refundable.
- Free Content: A portion of our content is available for free without a subscription. This content may change at our discretion.
- Bulk Subscriptions: If your access is provided through a bulk subscription (e.g., through a state-level agreement), your use is governed by the terms of that agreement. Please contact your organization or state administrator for details.
3. Intellectual Property Rights
- Ownership: The Change Agent, NELRC, and World Education (JSI Research & Training Institute Inc.) own all content, features, and functionality of the Service, including all text, graphics, logos, images, and software. This content is protected by copyright, trademark, and other intellectual property laws.
- Limited License: When you subscribe or access free content, you are granted a limited, non-exclusive, non-transferable license to use the content for your personal, non-commercial, educational use only.
- Restrictions: You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content from the Service without express written permission. You may not use any automated tools (e.g., bots, spiders) to access or collect content from the Service.
4. User-Submitted Content
- Originality: The Change Agent features writings and creative works by adult learners. By submitting your work to us, you represent and warrant that the content is your own original creation and does not infringe on the intellectual property rights of others.
- License to Publish: By submitting your content, you grant The Change Agent and World Education (JSI Research & Training Institute Inc) a perpetual, non-exclusive, royalty-free, worldwide license to publish, reproduce, distribute, and display your work in any medium (including print and digital formats) as part of The Change Agent and related promotional materials.
- Editing: You acknowledge that your submission may be edited for clarity, length, grammar, and style. We will make reasonable efforts to maintain the original meaning and voice of your work.
5. Donations
The Change Agent is a project of World Education (JSI Research & Training Institute Inc). Donations are managed by World Education (JSI Research & Training Institute Inc) and are tax-deductible as permitted by law. Your donation does not grant you additional rights to the Service beyond a standard subscription.
6. Disclaimer of Warranties
The Service is provided on an “as-is” and “as-available” basis. We do not guarantee that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We disclaim all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
7. Limitation of Liability
In no event shall The Change Agent, NELRC, World Education (JSI Research & Training Institute Inc), or its affiliates, employees, or agents be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.
8. General Provisions
- Governing Law: These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions.
- Changes to Terms: We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on our website. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
